Court orders case of rape and serious atrocities against Lenin - false complainant against Swami Nithyananda

In one more victory for Swami Nithyananda, the Principal District and Sessions Judge, Ramanagara today issued summons to Lenin Karuppan the false complainant in the case against Swami Nithyananda, accused in a serious atrocities case of rape, to be tried in a timebound of 2 months. The Hon’ble Court has ordered for investigation and filing chargesheet and issued summons to Lenin.

On 12 March 2013, the Hon’ble High Court of Karnataka had ordered for FIR to be filed in the said case filed by Ms. Pushpa against Lenin Karuppan for his attempt to rape her, extortion and threat to kill her. The police thereafter registered the complaint and FIR in Cr. N. 0077/2013 at Bidadi Police Station, on 11 March 2013. The High Court had directed the police to investigate the matter in accordance with law.

The Hon’ble Sessions Court today ordered for the chargesheet to be filed after the investigation and has taken cognizance of the offences under Sections 376 (rape), 341 (wrongful restraint), 506 (criminal intimidation), 504 (intentional insult with intent to provoke breach of peace) of the Indian Penal Code and under Section 3(1)(r) of SC ST Act (intentionally insults or intimidates with intent to humiliate a member of a Scheduled Caste or a Scheduled Tribe in any place within public view). Due to the seriousness of the case, the law under the SC/ST Act requires the case to be completed in a time bound of 2 months.

As a part of a major conspiracy against Swami Nithyananda, Lenin Karuppan abetted by his accomplices had fabricated a sensational video showing Swami Nithyananda with an actress and in the wake of the media frenzy thus generated had filed the false case against Swami Nithyananda in 2010.

This ruling marks a series of judgments in favour of Swami Nithyananda by various Courts of India. The Hon’ble High Court of Karnataka had earlier quashed the cases filed against Swami Nithyananda in 2012 by some vested elements. A few months ago, the Hon’ble High Court of Karnataka further ordered the investigating authorities to submit all the evidences found favoring Swami Nithyananda in their investigations. This order was subsequently upheld by the Hon’ble Supreme Court of India which categorically observed that the evidences of sterling quality should be considered by the Court even if they were suppressed by the investigation and prosecution.

These evidences include the medical reports of the alleged rape victim Ms. Arathi Rao from 2004 to 2009 showing she has had 4 highly contagious and incurable STDs some of which are transmitted by mere touch, her own email admission in mid-2009 six months after her last alleged instance of rape that she never had any kind of sexual relationship with Swami Nithyananda, multiple proofs of discrepancies in the dates and locations of the alleged rape incidents, Swami Nithyananda’s medical reports showing he has never had any STDs and has a yogic body and not capable of a sexual act, the critical witness statement of Ms Ranjitha stating that the video showing her with Swami Nithyananda is a fake and morphed one.

Lenin Karuppan and Arathi Rao are currently facing prosecution for the blackmail, extortion and criminal conspiracy by them against Swami Nithyananda in the trial Court in Chennai.

Lenin Karuppan e Arathi Rao enfrentam atualmente a acusação pela chantagem, extorsão e conspiração criminosa por parte deles contra Swami Nithyananda no tribunal de julgamento em Chennai. Hoje dia 22 de Janeiro de 2018, mais uma vitória de Bhagavan Sri Nithyananda Paramashivam, o Juiz do Distrito Principal e das Sessões, Ramanagara convocou hoje Lenin Karuppan, o falso queixoso no processo contra Sua Divina Santidade (SDS), acusado num caso de atrocidades graves de violação, para ser julgado num prazo de 2 meses. O Tribunal de Hon'ble ordenou a investigação e a apresentação da acusação e emitiu uma citação a Lenine.

O Supremo Tribunal de Karnataka de Hon'ble tinha ordenado que o FIR fosse arquivado no referido processo apresentado pela Sra. Pushpa contra Lenin Karuppan pela sua tentativa de a violar, extorsão e ameaça de a matar.

A polícia registou posteriormente a queixa e o FIR em Cr. N. 0077/2013 na esquadra de polícia de Bidadi, a 11 de Março de 2013.
O Supremo Tribunal tinha instruído a polícia a investigar o assunto de acordo com a lei.

O Tribunal de Hon'ble ordenou hoje que a ficha de acusação fosse apresentada após a investigação e tomou conhecimento das infracções ao abrigo dos artigos 376º (violação), 341º (restrição injusta), 506º (intimidação criminal), 504 (insulto intencional com intenção de provocar a violação da paz) do Código Penal indiano e ao abrigo da Secção 3(1)(r) da Lei SC ST (insulta intencionalmente ou intimida com intenção de humilhar um membro de uma Casta. Programada ou de uma Tribo Programada em qualquer lugar à vista do público). Devido à gravidade do caso, a lei ao abrigo da Lei SC/ST exige que o caso seja concluído num prazo de 2 meses. Como parte de uma grande conspiração contra SDS Swami Nithyananda, Lenin Karuppan, incitado pelos seus cúmplices, fabricou um sensacional vídeo em que mostra SDS Swami Nithyananda com uma atriz e, na sequência do frenesim mediático assim gerado, apresentou o falso caso contra SDS Swami Nithyananda em 2010. Esta decisão marca uma série de julgamentos a favor de Sua Divina Santidade Bhagavan Sri Nithyananda Paramashivam, por vários Tribunais da Índia. O Tribunal Superior de Karnataka de Hon'ble tinha anteriormente anulado os casos apresentados contra Bhagavan Sri Nithyananda Paramashivam em 2012 por alguns elementos investidos.

Há alguns meses, o Supremo Tribunal de Karnataka de Hon'ble ordenou ainda às autoridades investigadoras que apresentassem todas as provas encontradas a favor de SDS nas suas investigações.

Esta ordem foi posteriormente confirmada pelo Supremo Tribunal de Hon'ble da Índia, que observou categoricamente que as provas de qualidade esterlina deveriam ser consideradas pelo Tribunal mesmo que fossem suprimidas pela investigação e acusação. Estas provas incluem os relatórios médicos da alegada vítima de violação, a Sra. Arathi Rao de 2004 a 2009 mostrando que teve 4 DSTs altamente contagiosas e incuráveis, algumas das quais transmitidas por mero toque, a sua própria admissão por e-mail em meados de 2009, seis meses após o seu último alegado caso de violação que nunca teve qualquer tipo de relação sexual com Swami Nithyananda, múltiplas provas de discrepâncias nas datas e locais dos alegados incidentes de violação, os relatórios médicos de SDS Bagahavan Sri Nithyananda Paramashivam, mostrando que nunca teve nenhuma DST e que tem um corpo iogues e não é capaz de um ato sexual, a declaração crítica da Sra. Ranjitha afirmando que o vídeo que a mostra com Swami Nithyananda é falso e mortificado. Lenin Karuppan e Arathi Rao enfrentam atualmente a acusação pela chantagem, extorsão e conspiração criminosa por parte deles contra Swami Nithyananda no tribunal de julgamento em Chennai.
